1. Introduction and Scope
1.1 These Booking Conditions ("Terms") set out the basis on which Your Travel Consultant Ltd ("we", "us", "our") supplies or arranges travel services to you ("you", "your"). They apply to bookings you make directly with us or via our authorised agents.
1.2 Our roles. We usually act as agent for the supplier(s) named on your confirmation (e.g., airline, tour operator, hotel). In those cases, your contract is with the relevant supplier(s) and their booking conditions apply. Where we act as agent, your booking is subject to the supplier’s terms and conditions, which will be sent to you at the time of booking. In some cases, we act as organiser of a Package under the Package Travel and Linked Travel Arrangements Regulations 2018 (the "PTRs"). Where we act as organiser, your contract is with us for the package as a whole and different rights apply (see Sections 3, 8, 10, 11). We will make clear at the time of booking which role we are performing.
1.3 By making a booking, you confirm you are over 18, have read these Terms and have authority from all persons named to be bound by them. Please save/print a copy of these Terms for your records.
2. ATOL Protection and Financial Security
2.1 ATOL 12789. We hold an Air Travel Organiser’s Licence (ATOL 12789) issued by the UK Civil Aviation Authority (CAA). Some flights and flight‑inclusive holidays we sell are ATOL‑protected. ATOL protection does not apply to all travel services. We will always tell you before you book whether your booking is ATOL‑protected.
2.2 ATOL Certificate – issued immediately on first payment. When you make the first payment for any ATOL‑protected booking, we or our authorised agent will issue your ATOL Certificate immediately. Please check it carefully and ensure it lists all the services you booked. If you do not receive an ATOL Certificate, the booking is not ATOL‑protected. If any service is missing from the Certificate, that service is not ATOL‑protected. We will re‑issue your Certificate promptly if your arrangements materially change.
2.3 Your ATOL protection if we cease trading. For ATOL‑protected bookings, if we cease trading, you will either (a) be able to continue your trip as planned or (b) receive a refund (and, if already travelling, repatriation). Your protection is as described on your ATOL Certificate and under the ATOL scheme.
2.4 What to do in the event of failure. If we cease trading, please follow the instructions at www.atol.org (including repatriation arrangements and refund claims) or call the CAA on (+44) 333 103 6350.
2.5 Standard ATOL wording (Standard Term 1.5).
We, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable).
2.5.1 Standard Term 1.7 A.
If we, or the suppliers identified on your ATOL certificate, are unable to provide the services listed (or a suitable alternative, through an alternative ATOL holder or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme. You agree that in return for such a payment or benefit you assign absolutely to those Trustees any claims which you have or may have arising out of or relating to the non-provision of the services, including any claim against us, the travel agent (or your credit card issuer where applicable). You also agree that any such claims may be re-assigned to another body, if that other body has paid sums you have claimed under the ATOL scheme.
2.5.2 Standard Term 1.7 B.
When you buy an ATOL protected flight or flight inclusive holiday from us you will receive an ATOL Certificate. This lists what is financially protected, where you can get information on what this means for you and who to contact if things go wrong.
2.6 Non‑ATOL bookings. If your booking is not ATOL‑protected, we will clearly tell you the alternative financial protection in place before you book (e.g., Protected Trust Services, supplier failure insurance or another legally compliant method). We will not display the ATOL logo or number in a way that implies ATOL protection for non‑ATOL bookings.
2.7 Additional legal protections. If you buy a Package, you will also have protections under the PTRs (see Section 3), which apply whether or not the package is ATOL‑protected.
3. Packages and Linked Travel Arrangements
3.1 When a Package exists. A Package exists where, for the same trip, you purchase a combination of at least two different types of travel services (transport, accommodation, motor vehicle hire, or other tourist services) that meet the criteria in the PTRs (e.g., sold at an inclusive price, under a single contract, selected as part of the same booking process, advertised as a "package"). We maintain systems to identify when a combination forms a Package and will tell you when you are buying one.
3.2 Organiser responsibilities. Where we are the organiser, we are responsible for the proper performance of the package and your statutory rights apply, including rights to price reductions/compensation where appropriate, the right to transfer your booking, assistance if you are in difficulty, and refunds within statutory deadlines (see Sections 7–11).
3.3 Pre‑contract information & confirmation. Before you are bound by a package contract we will provide the prescribed pre‑contract information. After booking, we will provide a package confirmation containing all required details. If we must significantly change key characteristics or cannot fulfil the package, you may accept changes, take a substitute package, or cancel with a full refund.
3.4 Linked Travel Arrangements (LTAs). If we facilitate an LTA (e.g., a linked online booking leading to a second purchase within 24 hours), we will provide the prescribed LTA information form and ensure compliant insolvency protection for monies we receive, as required by the PTRs. LTAs are not Packages and confer different rights.
3.5 No general ‘cooling‑off’. There is no automatic statutory cooling‑off period for Packages. Your cancellation and transfer rights are set out in these Terms and the PTRs.
4. Booking Process and Documentation
4.1 Making a booking. The lead traveller is responsible for the accuracy of all information provided and for passing on all information to other travellers. You must check all details provided on any documents we issue and notify us immediately of any errors.
4.2 Contract formation. No contract exists for any component until it is confirmed by the relevant supplier (or by us, where we act as organiser). For agent sales, your contract is with the supplier(s) named on your documentation; their terms apply. Where we act as agent, we will provide (and/or send) the applicable supplier terms and conditions to you at the time of booking.
4.3 Names & documents. Ensure names match passports exactly. You are responsible for meeting passport, visa, health and entry requirements (see Section 16).
4.4 ATOL notification. For ATOL‑protected bookings, we will clearly show the protection applicable during the booking process and on your confirmation, and we will issue the ATOL Certificate immediately on first payment (Section 2.2).
5. Pricing, Deposits, Balance and Payments
5.1 Deposits and balance. You must pay either a deposit or the full price at booking as notified to you. If a deposit is taken, the balance is due by the date shown on your confirmation. If payment is not received on time, the supplier (or we, if organiser) may cancel your booking and charge the applicable cancellation fees.
5.2 Monies held. For ATOL‑protected bookings, monies are held/processed in accordance with ATOL requirements. For non‑ATOL bookings, unless stated otherwise, monies are held on behalf of the supplier(s). Where we act as organiser of a non‑flight package, monies are protected via PTS or an alternative compliant method.
5.3 Price corrections and obvious errors. We may correct advertised/quoted prices where there is a genuine error or where a supplier changes price before your booking is confirmed. We will advise you before you are bound.
6. Package Price Changes (Organiser bookings only)
6.1 When prices may change. After you book a Package with us as organiser, your price may change upwards or downwards to reflect variations in: (a) transport fuel or other power costs; (b) taxes, fees or charges imposed by third parties (including tourist taxes, landing fees or embarkation/disembarkation fees at ports and airports); or (c) exchange rates relevant to your package.
6.2 Limits and timing. If the increase is more than 8% of the total package price, you may accept the change, take a substitute package (if offered), or cancel with a full refund. We will not increase prices within 20 days of departure.
6.3 Downward revisions. If the costs listed in 6.1 decrease after booking, you are entitled to a price reduction, less any administrative expenses we reasonably incur.
7. If You Change or Cancel Your Booking
7.1 All bookings. Any request to change or cancel must be made in writing by the lead traveller and takes effect when received by us. For agent bookings, the supplier’s change/cancellation terms apply and charges may be up to 100% of the price. Our service fees (if any) are non‑refundable unless required by law.
7.2 Package bookings where we are organiser – your cancellation. You may cancel your package at any time before it starts. We will deduct reasonable and justifiable cancellation charges based on expected cost savings and income from alternative use of the travel services. Our standard scale (unless your confirmation states otherwise) is:

More than 70 days before departure: Deposit only

69–42 days: 30% of total price (or deposit, if greater)

41–28 days: 50% of total price

27–15 days: 80% of total price

14 days or fewer: 100% of total price
We will provide a breakdown on request. If the actual costs are lower than the scale, we will reduce the charge accordingly.
7.3 Transfers of package bookings (organiser). You may transfer a package to another person who satisfies the contract conditions by giving us reasonable notice (no later than 7 days before departure) and paying all actual costs we incur in making the transfer.
7.4 Refund timing for packages. Where you are entitled to a refund under the PTRs (e.g., cancellation due to significant changes), we will refund you within 14 days of termination.
8. Changes or Cancellations by Suppliers or by Us
8.1 Supplier‑booked arrangements (agent). If a supplier changes or cancels your booking, we will pass on information as soon as reasonably possible. Your rights will be as set out in that supplier’s terms (which may include refunds, alternatives or compensation). We are not responsible for supplier performance where we act only as agent.
8.2 Packages we organise. We may make minor changes to your package, which do not entitle you to cancel. If we must make a significant change (e.g., change of destination, downgrade of accommodation standard, significant change of transport times) or cancel your package, we will tell you promptly. You may accept the change, take a substitute package (if offered), or cancel with a full refund. Where appropriate, you may also be entitled to compensation, except where the change is due to unavoidable and extraordinary circumstances.
8.3 Unavoidable and extraordinary circumstances. We will not pay compensation where the change/cancellation is caused by events beyond our control (e.g., war, terrorism, significant risks to health such as pandemics, natural disasters, severe weather, industrial disputes, air traffic/airport decisions). Refund rights and assistance still apply as required by law.
8.4 Refund timing. Any refund due for a package will be made within 14 days of termination.
9. Our Service Charges
We may charge reasonable service fees, which will be shown on your confirmation, for: administration, supplier failure cover (where applicable), changes/cancellations you request, and issuing/reissuing documentation (including ATOL Certificates where a re‑issue is required due to changes).
10. Responsibility and Liability
10.1 Agent sales. Where we act as agent, we arrange your booking in accordance with your instructions. We are not a party to your contract with the supplier and accept no responsibility for the actual provision of the services. We accept responsibility only for our own acts/omissions. If we are found liable for any reason, our maximum liability shall be limited to three times the total price of your booking (or the appropriate proportion if not all travellers are affected), except where the law provides otherwise.
10.2 Packages we organise. We are responsible for the proper performance of all travel services included in your package, as required by the PTRs. Our liability may be limited in accordance with applicable international conventions (e.g., Montreal, Athens, Berne/COTIF, Paris) and relevant EU/UK regulations.
10.3 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be limited under applicable law. Your statutory rights are unaffected.
11. Assistance If You Are in Difficulty (Packages we organise)
If you are in difficulty during your trip, we will provide appropriate assistance without undue delay, including information on health services, local authorities and consular assistance, and help with distance communications and alternative travel arrangements. Where the difficulty is caused intentionally or by your negligence, we may charge a reasonable fee for such assistance.
12. Complaints and Dispute Resolution
12.1 While travelling. Please raise any issue immediately with the relevant supplier/representative so they can try to resolve it on the spot. If not resolved, contact us using the details on your confirmation.
12.2 After you return. Please submit any complaint in writing within a reasonable time. Where we are organiser, we will acknowledge within 48 hours and aim to respond in full within 28 days.
12.3 Escalation/ADR. If we cannot resolve your complaint, you may be able to use an alternative dispute resolution (ADR) scheme (e.g., through a recognised trade body or approved ADR entity). Details will be provided on request.
12.4 ATOL‑specific issues. For complaints relating to ATOL protection or your ATOL Certificate, you may also contact the CAA. This does not affect your right to seek other redress.
13. Your Financial Protection (Summary)
13.1 ATOL‑protected bookings. You will receive an ATOL Certificate listing the parts of your booking that are ATOL‑protected under ATOL 12789. Keep it safe and take it with you.
13.2 Non‑ATOL bookings & non‑flight packages. Where we act as organiser of a non‑flight package, or where ATOL does not apply, we protect customer monies in accordance with the PTRs, typically through Protected Trust Services (PTS) or another compliant method, as notified to you before you book.
13.3 Scope. ATOL protection generally covers you if we (as ATOL holder) fail or if the airline fails (as described in your Certificate). It does not protect against the failure of non‑air suppliers unless the booking is part of an ATOL‑protected package or flight‑plus as specified on your Certificate.
14. Special Requests; Disabilities & Medical
14.1 Special requests. Tell us of any special requests at booking. We will pass them to suppliers but cannot guarantee they will be met.
14.2 Reduced mobility/medical needs. If you have a disability, medical condition or reduced mobility that may affect your trip, please provide full details before booking so we (and suppliers) can advise on suitability and reasonable adjustments.
15. Insurance
15.1 We strongly recommend that you take out comprehensive travel insurance as soon as you book, covering cancellation/curtailment, medical expenses (including repatriation), baggage, personal liability, and supplier failure where appropriate.
15.2 It is your responsibility to ensure any policy you purchase is suitable for your needs and discloses any pre‑existing medical conditions.
16. Passports, Visas, Entry, Health & Safety
16.1 You are responsible for meeting all passport, visa, entry, health and vaccination requirements for your itinerary (including any transit points). We can provide general guidance, but requirements may change at short notice; you must check the latest official advice.
16.2 Airlines/suppliers or border authorities may refuse travel if your documentation is not in order; we are not liable for resulting losses.
17. Behaviour and Damage
17.1 Suppliers may refuse service or terminate your arrangements (without refund) if your behaviour is inappropriate, causes risk, distress or damage, or affects the enjoyment of others. You are liable for any damage or losses caused by you and must indemnify us against associated claims, costs and expenses.
18. Data Protection and Privacy
18.1 We process personal data in accordance with UK GDPR and the Data Protection Act 2018. See our Privacy Notice for details.
18.2 ATOL data. For ATOL‑protected bookings we must share certain personal/booking data with the CAA and/or the Air Travel Trust to issue and administer ATOL Certificates and for compliance purposes.
18.3 We may share data with suppliers and service providers (including outside the UK/EEA) as necessary to perform your contract, with appropriate safeguards. We retain data only as long as necessary to fulfil purposes, comply with legal obligations and resolve disputes.
18.4 You have rights to access, rectification, erasure, restriction, portability and objection. You may complain to the ICO. See our Privacy Notice for how to exercise your rights.
19. Law and Jurisdiction
19.1 These Terms and any dispute arising from them are governed by English law. The courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may bring proceedings in your local courts.
20. Force Majeure (Unavoidable and Extraordinary Circumstances)
We are not liable for failure to perform or for performance being affected by events beyond our control (see 8.3). This does not affect your rights to refunds/assistance under the PTRs for packages we organise or your rights under the ATOL scheme where applicable.
21. Final Travel Arrangements
21.1 Please check your travel documents carefully and ensure you arrive at airports/terminals in good time. Airlines may require you to reconfirm flights; follow any instructions in your documentation/airline communications.
21.2 For ATOL‑protected flights, any specific reconfirmation requirements will be set out in your travel documents and ATOL Certificate.
22. Third‑Party Websites and Services
Our website may link to third‑party sites/services which we do not control or endorse. We are not responsible for their content, availability or services.
23. Right to Refuse Service
We may refuse service to any person whose behaviour towards our staff, agents or other customers is abusive, threatening, discriminatory, fraudulent or otherwise inappropriate.
24. Agents and Advertising Compliance
24.1 Authorised agents. We sell through authorised agents who must comply with CAA/ATOL requirements and our Agency Terms, including correct display of ATOL 12789 and immediate issue of ATOL Certificates on first payment.
24.2 Unauthorised sellers. We are not responsible for bookings made through unauthorised third parties. To verify an agent, contact hello@yourtravelconsultant.co.uk.
24.3 Advertising. We will not display the ATOL logo/number in a way that implies ATOL protection where it does not apply. All documents and adverts for ATOL‑protected sales will clearly state our ATOL number 12789.
25. Amendments to These Terms
We may amend these Terms from time to time. The version that applies is the one in force at the time you make your booking. We will notify you of any material changes. Amendments will not affect your statutory rights or your rights under ATOL/PTRs.
26. Non‑Transferability (General) and Transfers (Packages)
26.1 General. Bookings are generally non‑transferable unless permitted by the supplier’s terms.
26.2 Packages (organiser). Notwithstanding 26.1, for packages you may transfer your booking to another person who satisfies all conditions of the contract by giving us reasonable notice (no later than 7 days before departure) and paying all actual costs arising from the transfer.
27. Additional Legal Notes and Liability Carve‑outs
27.1 No limitation of statutory rights. Nothing in these Terms affects your rights under applicable consumer law or the PTRs.
27.2 Mandatory carve‑outs. Nothing excludes or limits liability for death/personal injury caused by negligence or for fraud/fraudulent misrepresentation.
27.3 Consequential loss. Except where we act as organiser and the PTRs apply, we are not liable for indirect or consequential losses that were not foreseeable when you booked.
28. Health, Safety and Travel Advice
28.1 You must check up‑to‑date FCDO travel advice, health/vaccination requirements and any local regulations/restrictions for your destination(s).
28.2 We may refuse a booking if we reasonably consider it unsafe or unsuitable for your circumstances.
29. Pre‑Travel Checklist
We recommend reviewing our pre‑travel checklist at least one week before departure to ensure you have: valid passports/visas, insurance, tickets/vouchers, entry/health documentation, local contact information, and a means of payment while abroad.
